Sergio Niz-Mendez, a 27-year-old citizen of Guatemala, pled guilty on March 23 in federal court in Sioux City to charges of illegal reentry into the United States and failure to register as a sex offender.
Niz-Mendez’s case highlights ongoing efforts by law enforcement to address illegal immigration and ensure compliance with sex offender registration laws. These measures are intended to protect communities from individuals who have committed serious offenses and reentered the country without authorization.
During the plea hearing, Niz-Mendez admitted that he had previously been removed from the United States in 2018 and had not received permission to return. He also acknowledged that he was required to register as a sex offender due to a conviction for rape of a child with force in Massachusetts in 2016, but failed to do so. Authorities discovered him in O’Brien County, Iowa, after he was arrested for operating while intoxicated and eluding law enforcement.
Sentencing will be scheduled following completion of a presentence report before United States District Court Judge Leonard T. Strand. Niz-Mendez remains in custody pending sentencing. For his conviction on illegal reentry, he faces up to two years’ imprisonment, a $250,000 fine, and one year of supervised release. The charge for failing to register as a sex offender carries a maximum sentence of ten years’ imprisonment, another $250,000 fine, and five years up to life on supervised release.
This prosecution is part of Operation Take Back America—a nationwide initiative utilizing Department of Justice resources aimed at addressing illegal immigration issues and targeting criminal organizations.
